Dugan and Giroux Law Inc. primarily handles personal injury litigation on behalf of the injured party and/or parties. Those cases typically involve situations wherein an individual suffers an injury to his/her person which requires medical treatment and possibly economic loss as a result of another’s negligent act. Negligence can be defined as a failure of a duty owed to another. The most common types of personal injury claims involve auto accidents, slip and fall or premises liability cases.
What is Premises Liability?
Premises liability is when an injury is caused by some type of unsafe or defective condition on someone’s property. This can range anywhere from injuries caused by a variety of hazardous conditions, including, dog bites, swimming pool accidents, uneven pavement, standing water, wet floors, uncleared snow, icy walkways, insufficient lighting, concealed holes, or improperly secured mats.
Wrongful Death
Wrongful death exists when a person dies due to the legal fault of another person and surviving members of the victim’s family sue. The purpose of a wrongful death claim is to compensate the survivors, not the victim. The family members who file a wrongful death claim must prove that they have been directly impacted by the passing of their loved ones. This could be emotionally and/or financially.
What should you do in the event of a vehicle accident?
If you happen to get into a vehicle accident, make sure to remain calm. Never leave the scene. Check on all drivers and passengers and call the police. You will want to exchange information from all drivers involved, such as, names, numbers, addresses, drivers’ license numbers, license plate numbers, and basic insurance information. If there were witnesses, ask what they saw and get their names and numbers. Inform your insurance company about the accident. Take pictures of the damage done on your vehicle and other vehicles involved.
